Right to Work Document Examples: Non UK (Overseas)

Here you will find examples of the documents which will need to be obtained if a person is not a British or Irish citizen. 

Everyone who is not a British Citizen will either need an Employer Checking Service check (ECS check) or a share code check.

 

A share code check and an ECS check are the only documents you need to prove a person has the right to work in the UK. However they cannot be used as a form of photo id, separate photo ID document will also need to be obtained before a person starts work.

 

Please note: All right to work documents need to be in a person's current name. If the documents are not in the person's current name then a name change document will need to be obtained. These can include:

  • Marriage or civil partnership certificate
  • Overseas marriage or civil partnership certificate
  • Deed poll certificate

 

Employer checking service (ECS)

 

This is a service used by employers to check a person's right to work status. This service can be used if a person has an outstanding appeal or application with the home office, or they cannot show their right to work documents. These checks have an expiry date and will need to be re-run after the check has expired unless the person can provide their documents or share code. Please see below for an examples of ECS checks:

Share code 

A share code is a number people are given to give to their employers. This allows the employer to check a person's right to work status. 

The share code was introduced in July 2019 as part of a post-Brexit law. They were used to make the process of right to work checks easier for the employee and the employer. 

The expiry date of a share code check can depend on a person's right to work status. The expiry date can vary from 1 month to 5 years. After the expiry date on the check the employer will be required to re-run the share code check. 

Please see below for an example of a share code check:

This check will then need to be downloaded as a PDF and retained for the entire duration of an employees employment and for 2 years after. 

Each check will contain the following information:

  • Full name
  • Name of the company who conducted the check
  • Expire date of check and right to work status
  • Conditions. E.g. what jobs they cannot do
  • Picture of the person
